Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Paint Pilot website and platform located at usepaintpilot.com, operated by Paint Pilot, LLC, a Florida limited liability company (“Paint Pilot,” “we,” “our,” or “us”). By accessing or using the platform you agree to be bound by these Terms. If you do not agree, do not use the platform.

Paint Pilot is a lead-generation and matching platform that connects homeowners seeking residential painting services with local painters who represent that they are licensed and insured. Paint Pilot is not a painting contractor and does not perform any painting services. We are not a party to any agreement between a homeowner and a painter.

The platform has two types of users:

• Homeowners — individuals who submit painting project requests to receive quotes from painters.
• Painters — painters who represent that they are licensed and insured, and who purchase homeowner leads and contact homeowners directly.

You must be at least 18 years old to use the platform. By using the platform you represent that you meet this requirement and that all information you provide is accurate and complete.

Painters must hold all licenses, insurance, and certifications required by their state and local jurisdiction. Painters represent and warrant that the credentials they submit for verification are authentic, current, and belong to them.

Submitting a Request

Submitting a project request is free. You agree to provide accurate information about your project. Submitting false, misleading, or incomplete information may result in removal of your request and termination of your account.

Lead Distribution

Your project lead may be purchased by up to four (4) painters who match your service type, location, and availability. Painters who purchase your lead will receive your name, email address, and phone number. Your contact information is not shared until a painter purchases your lead.

Leads expire 24 hours after submission. Paint Pilot does not guarantee that any painter will purchase your lead or that you will receive any quotes.

Color Consultations

A complimentary color consultation is offered with every project request. Consultation recommendations are informational only. Paint Pilot's color suggestions are not professional interior design advice and Paint Pilot bears no responsibility for color choices made based on those suggestions.

Hiring a Painter

Any agreement you enter into with a painter is solely between you and that painter. Paint Pilot is not a party to that agreement, does not guarantee the quality of any painter's work, and is not responsible for any disputes, damages, or losses arising from your relationship with a painter.

Account Requirements

To create a painter account you must provide accurate business information, a valid payment method, and submit documentation for verification. Paint Pilot reserves the right to reject or suspend any painter account at its sole discretion.

Lead Purchases

Leads are sold on a first-come, first-served basis at prices set by Paint Pilot based on service type, project scope, and other factors described in our pricing documentation. By clicking “Buy Lead” you authorize Paint Pilot to charge your stored payment method immediately.

Each lead may be sold to a maximum of four (4) painters. Once you purchase a lead, that purchase is final. All lead purchases are non-refundable except as described in Section 5.

Contacting Homeowners

You agree to contact homeowners only through the channels they have indicated (phone, text, or email) and only in connection with the project for which you purchased the lead. Unsolicited marketing, harassment, or any contact unrelated to the purchased lead is prohibited and may result in account termination.

Painter Communications Compliance

When you purchase a lead and contact a homeowner, you are solely responsible for complying with all laws governing that contact, including the federal Telephone Consumer Protection Act (TCPA), the federal Do Not Call Registry rules, the CAN-SPAM Act, the Florida Telephone Solicitation Act (FTSA), and any other applicable telemarketing, calling, or texting laws. You represent and warrant that you will contact homeowners only through the channels they have authorized and only regarding the project for which you purchased the lead. You agree to indemnify, defend, and hold harmless Paint Pilot, LLC and its members, managers, employees, and agents from any claims, liabilities, damages, penalties, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your communications with any homeowner, including any claim that your call, text, or email violated the TCPA, the FTSA, the Do Not Call rules, or any other law. This obligation is in addition to the general indemnification elsewhere in these Terms.

Prohibited Conduct

• Purchasing leads for the purpose of reselling them to other contractors.
• Creating multiple accounts to circumvent purchasing limits or refund policies.
• Providing false verification documents.
• Contacting homeowners with misleading information about your qualifications.
• Circumventing the platform by directing homeowners to contact you through unofficial channels for future work in order to avoid our system.

Lead purchases are non-refundable as a general rule. We will issue a refund in the following limited circumstances:

• The homeowner's contact information is incorrect or the homeowner is completely unresponsive to all three outreach attempts documented within the lead dashboard.
• The project details are materially inaccurate (e.g., the lead was listed as residential but is a commercial property).
• A technical error resulted in a duplicate charge or an unauthorized charge.

Refund requests must be submitted through your painter dashboard within 7 days of the lead purchase. Paint Pilot reviews all requests and its determination is final.

All payments are processed by Stripe. By providing a payment method you authorize Paint Pilot to charge that method for lead purchases. You are responsible for ensuring your payment method remains current and valid.

All prices are displayed in U.S. dollars. Paint Pilot reserves the right to change lead pricing at any time with reasonable notice.

The Paint Pilot name, logo, website design, and all content we create are owned by Paint Pilot, LLC. You may not copy, reproduce, distribute, or create derivative works from our content without prior written permission.

By uploading photos or other content to the platform you grant Paint Pilot a non-exclusive, worldwide, royalty-free license to use, store, and display that content solely for the purpose of operating the platform and delivering your color consultation.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Paint Pilot does not warrant that the platform will be uninterrupted, error-free, or free of viruses or harmful components.

Paint Pilot does not verify the accuracy of homeowner project descriptions or guarantee painter performance, and expressly disclaims responsibility for any disputes between homeowners and painters.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAINT PILOT, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL PAINT PILOT'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO PAINT PILOT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Paint Pilot, LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or any dispute between you and another user.

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS. You and Paint Pilot, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the platform, or any communications you receive in connection with the platform (including claims under the Telephone Consumer Protection Act) will be resolved by binding individual arbitration, not in court, except that either party may bring an individual claim in small claims court.

Class Action Waiver: each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding; the arbitrator may not consolidate claims or preside over any representative or class proceeding.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, in Sarasota County, Florida, or at your election by phone, video, or written submission.

30-Day Opt-Out: you may opt out within 30 days of first accepting these Terms by emailing [email protected] with the subject “Arbitration Opt-Out” and your account email; opting out affects no other part of these Terms.

Severability: if the class action waiver is found unenforceable as to a claim, that claim alone severs and proceeds in court.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to personal jurisdiction in those courts.

Informal resolution. Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Paint Pilot reserves the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or platform notification. Your continued use of the platform after the effective date constitutes acceptance of the modified Terms.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may close your account at any time by emailing us. Termination does not relieve you of obligations incurred prior to termination, including any outstanding payment obligations.
